1. What do I do if I am arrested?

   If a person is arrested, he or she should contact a lawyer as soon as is practicable to find out about that person’s rights. The person should also make extensive notes about the circumstances leading up to the arrest, the arrest itself, and the events following the arrest for the purpose of giving the lawyer a full and complete explanation of what happened. 
   

2. Do I have to talk with the police or other law enforcement agent(s) after I have been arrested. 

   A citizen accused has a right to remain silence and a right to have an attorney present when the citizen is questioned by law enforcement agent(s). 
   

3. Do I have to sign papers if the police ask me to do so?

   A person does not have to sign papers at the request of law enforcement agents without the opportunity to have the papers reviewed by an attorney of the person’s choice. 
   

4. Can an attorney make a “plea bargain” with the District Attorney or with the United States Attorney without my permission or knowledge. 

   In no event can an attorney make any “plea bargain” with state or federal authorities without the full knowledge and permission of the citizen accused.
   

5. Does the Judge have to follow a “plea bargain” reached among the citizen accused, the citizen’s attorney, and the prosecutor?

   The Judge is not bound by a “plea bargain” reached among a citizen accused, that citizen’s attorney, and the prosecutor.
